We at Simex Systems are committed to protecting your privacy. We will only use the information that we collect about you lawfully in accordance with the Data Protection Act 1998, and we will not pass your e-mail address or any other of your personal details to any third party. We will not e-mail you in the future unless you have given us your express consent.

These Terms and Conditions do not affect your statutory rights.The information contained on this website is not usually intended to be used by anyone less than 18 years of age and we are not prepared to contract with anyone under that age.

These terms regulate the legal relationship between yourself and us. These Terms and Conditions shall not be altered, modified or varied unless expressly agreed in writing by both parties.

The information on our website does not constitute a formal offer to sell Goods to you. Your Order is an Offer to buy Goods from us. Automatic confirmation of receipt of your Order does not constitute a Contract between us. A Contract for the Sale of Goods shall only arise on the despatch of our written confirmation of acceptance of your Order or the despatch of the Goods to you, whichever is the earlier.

The prices quoted may be subject to revision by us in the event of any increases imposed by the manufacturer before the date of despatch of Goods to you. We also reserve the right to amend the price in any sale before despatch arising where a pricing error has occurred either in favour of ourselves or you. In these cases we will contact you to notify you of the variation and you have the right either to proceed at the amended price or to revoke the Contract.

The price of Goods includes all packaging, insurance and administrative charges including delivery charges.

 We are entitled to present your cheque or credit card details to our Bank before despatching Goods to you and may delay despatch of Goods until after funds have cleared into the credit card or bank account.

We will try to arrange for delivery of all Orders within seven working days within EU countries and within twenty-one days for the rest of the world. However, should there be circumstances that delay dispatch or delivery, we will advise you of the likely delivery date and if you are unwilling to accept the delay, we will immediately cancel your cheque or card payment authority or refund your money if payment has already been made.

If on receipt of Goods you are dissatisfied with their quality or the Goods arrive damaged then you must advise us within 10 days by telephone, fax, e-mail or in writing. In the event of the Goods being damaged we may ask you to return or retain the Goods until our Insurance Claim is settled. If you return undamaged Goods in good condition, then upon receipt we will refund the price of the Goods (but not the cost of returning them to us). If the Goods are damaged we will return your payment plus the cost of returning the Goods to us.

If for any reason you are dissatisfied with your purchase, please return to us within 7 days of receipt. We will accept return of the product for full refund, provided that the goods are returned to us undamaged and still in their original packaging. The only exception to this is software. We can only accept returns of software if it is faulty.

Taxes and Duties
All Goods are sold to you according to United Kingdom Value Added Tax (VAT) law. This means that if you are registered within the EU (but outside the UK) for VAT the Goods are sold to you free of VAT. If you are based inside the UK or within the EU but not registered for VAT then the Goods are sold to you with VAT charged. If you are based outside the EU, the goods are sold to you free of VAT.
The payment of all other local Duties and Taxes including Import Duties (whether local to you or otherwise) is your responsibility.

Data Protection
We will not give out, sell or rent information about you to any other Company or Supplier. Your details will not be used by us or forwarded by us to any third parties for the purposes of unsolicited marketing.
We shall be entitled to vary or cancel any Contract with you, if necessary, through Act of God, war, strike, lock-outs, fire, flood, tempest, or any other cause beyond our control or if we are unable, for any reason, to obtain the Goods needed to perform our contract with you, when we shall not be responsible in any way to you for inability to deliver any Goods caused by such contingencies.

Whilst we make all reasonable attempts to exclude viruses from the website we cannot ensure such exclusion and no liability is accepted for viruses and thus you are recommended to take all appropriate safeguards before downloading information from this website.

These Terms and any claim based on the use of information from this website shall be governed by the laws of England and the parties submit to the exclusive jurisdiction of the Courts of England and Wales.
Purchasing a product from Simex Systems implies acceptance of these terms.
